You can download any game you own though, it would be silly, but you can. You own a license to play it. Downloading the game isn't inherintly illegal, its what you do with it afterwards

You are entitled to make a backup of what you own, and use it too. Downloading from the net means you are acquiring someone's backup that was legally supposed to be for his private use only.
We have 2 schemes: illegitimate aquisition, and illegitimate uses. - Downloading falls under the former. - Ripping music, videos, 3d models and putting those on P2P networks falls under the latter, as it counts as unauthorized redistribution. Public performance, and sometimes even renting counts as an illegitimate use as well. When you buy a game, you own the right to use it for the INTENDED purpose, playing, not redistributing, as other rights are specifically reserved for the authors (most of the time). The actual issue is with copyright laws around the world, as most are way behind the US laws. Wich is actually a good thing as DMCA and the likes are putting the Internet genie back into the bottle. A redistributor is bound by HIS country's laws, so even handling foreign content (like with Taiwan) altough morally wrong, is definitely NOT forbidden in such a situation. Unless the WTO pushes all legislations to uniformize on this (also China, Taiwan and Russia), this situation is likely to last for at least 20 years. BTW, we dont use software anymore, that's uncool, they call it "handcuffware" now... |

well so long as we have a right to backup what is ours.
Maybe if publishers would package two copies of the same game, would kind of help as you'd have a backup out of the box. Might increase piracy though (curses to them pirates! arrr!)... |
