I want to know one thing: Abandonware games are legal or ilegal? Imean, some1 here mentioned the Underdogs site and even posted a link to it. And what if the game is still being sold? Like Bio Menace. Its still being sold by apogee/3drealms, but most abandonware sites have it to download.

Yeah, it's illegal, it's just that companies are less inclined to enforce the law on such old games.

But games like caesar 1 is not illegal cuz the company offers it for free on their website.

If the company itself does offer it then it's in no way illegal.
I always have had a dream that the companies would create a compilation of the games of the previous console so that no gaming history get's lost but due to the fact I never see this happening is the reason why I got into emulation in the first place.

Underdogs doesn't offer games for download which the company will have a problem with or games still being sold somewhere. That is probably why the mods allowed the underdogs link to be posted.

Player-X, you are correct. That is exactally what it is referred to here in the USA. A "Grey Area Of The Law" simply means that it is technically unclear as to whether or not it is legal or illegal.
As for Underdogs.com they state that they only carry games that the companies have given their permission to be put up or games from companies that are no longer in business. If a company protests about a game being on Underdogs, then Underdogs will remove it.

Its like mod-chips. In the US, they should be protected under fair-use laws, but under the DCMA they are illigal, because they work around a copy protection. I don't know if there has ever been a ruling on them, which would justify them as either legal or illigal.
