PPSX demo discs

As we all know, demos of pc games are very common and can be distributed freely. I've noticed that outside Brazil there are lots of psx demo discs which are psx cds with lots of game demos on it.
The question is: Is the digital (internet) distribution of these demos illegal?

afaik, these demo discs are usually purchased or come with a specific magazine so they arent exactly free to distribute in the first place..
you can, however, use an epsxe savestate as a sort of demo..there used to be some sort of group around here that shared them..

Well, a lot of pc demo discs come with pc magazines... and those demos were downloaded from the internet, so, they're free.

Really? How come? AFAIK the savestates hold just small data... I think It's not even enough for a quick glance

just because something comes with a magazine, doesnt mean its free.. datel gave away copies of dvdx with its magazine once and that is still retail software. if its not offered by the company for free distribution, like pc demos usually are, i fail to see how anyone has the right to distribute it..

Omegainf, AFIK, magazines pay the companies for demo disks of their work. Then the magzine includes the demos in a certain issue, which you must buy. The key word is BUY. The magizines pay for the rights to the demo disks and you pay for the magazine which includes the demo disk. Therefore, the demo disks are not free. they have been paid for. Therefore, to freely distribute without having bought the magazine or copy them, would, to me, be illegal.

Im not sure. Wouldnt this be much like freeware? They have gave the rights to freely distribute the disc. So I think it would be fine?

No they haven't.
Read sxamiga's post more carefully. It is not free. It is part of the magazine. IE you cannot rip the disc off the magazine and say it's free. Must buy.
Did I mention it's not free?

It's analogy time again.
Say you buy a video card and it comes with "free" software like a DVD player or something. Is that CD freely distributed? No. Can you legally copy the CD and give to your friend? No.

So if you really want the demo, buy the magazine.
