This whole thing is most likely a legal/
pr move from Futuremark and NVidia, Futuremark re-words their statements in a way that doesn't look bad for NVidia, and they get back on NVidia's good side.
About ATI doing the same kind of "optimizations", there may be some hope yet, this was posted further below in the same thread:
